Afs Group provides to all members of its organization, including employees (permanent, interns, former employees or candidates) and Business partners (suppliers, subcontractors, joint venture partners, consultants, etc.), direct access to this online platform in accordance with the EU Directive 2019/1937 of the Parliament and of the Council of 23 October 2019, which is related to the
protection of persons reporting breaches of Union law.
This directive was implemented through the Legislative Degree. n. 24/2023 (Whistleblowing) and allows the reporting of possible violations, crimes, illicit or irregular behavior, even anonymously, provided that they are well-circumstantiated and committed by other individuals inside of the organization.

What can you report?

Behaviors, acts or actions may be the subject of reporting omissions that harm the public interest or compromise the integrity of the public administration or private entity. These behaviors may include, but are not limited to:
Administrative, accounting, civil or criminal violations that may cause financial damage, reputational damage or damage to the organization, to users, employees or other third parties operating within or on behalf of the organization.
Actions that violate the Code of Ethics, the Model of Organization and Management (MOG) pursuant to Legislative Degree 2 3 1 /2 0 01, the codes of law or others dispositions of companies subject to disciplinary sanctions .
Violations of European Union or national laws and regulations, such as public procurement, services, products or financial markets, prevention of money laundering and terrorist financing, product safety and compliance, transport safety, environmental protection, radiation protection and security nuclear, food and feed safety, public health, consumer protection, protection of privacy and personal data protection, security of networks and information systems.
Behavior that damages the financial interests of the European Union, as provided for in Article 325 of the Treaty on the Functioning of the European Union.
Actions or omissions that violate the internal market, as established in Article 26(2) of the Treaty on the Functioning of the European Union, including violations of EU competition and aid rules state, as well as corporate taxes.
Actions or behaviors that affect the object or purpose of the provisions of the European Union in the sectors mentioned above.

It is important to underline that the reports do not concern personal complaints, grievances or requests that fall within the framework of working relationships or relationships with hierarchical superiors or colleagues. For such matters, it is necessary to refer to the disciplinary procedures and skills of the Personnel Service and the Human Resources Function.
The reports must concern situations of which one became aware directly due to the employment relationship or which were acquired during the performance of work duties, even if randomly. Therefore, reports based on suspicions or rumors will not be taken into consideration, as the facts and the identity of the perpetrator must be highly probable.

What you will have to report?

To carry out the report, you must provide a written report containing the following information: Type of irregularity you wish to report. People involved. Place where the irregularity occurred. If the documentation is not directly available, but you know of its existence, indicate the type of documentation and where it could be found. Report management

Pursuant to current legislation, your report will initially be assessed by the company to determine whether it is suitable to be managed through the dedicated whistleblowing channel.

Each report will be assigned a unique case number and tracking code. We encourage you to retain this data so that you can access the system and monitor the status of your report, as well as receive any feedback.

You will also have the opportunity to provide additional information through the system.
Within seven days of submitting your report, you will receive a confirmation of receipt. Within 90 days, the company will provide you with feedback regarding how it handled the case. During this period, the counting of the deadlines necessary to respond to any requests for additional information will be suspended.
